Both products have separate data flows, purposes and in part different contractual constellations (end user vs. school/institution); use of one product does not give rise to data processing within the other. The provisions in Part B applicable to the app do not replace the privacy policy (Part C) that continues to apply separately to the marketplace service, but stand alongside it with equal rank.

Decisive for the applicability of Part B or Part C is the respective distribution channel: app store download/in-app use → Part B; use of the web-based marketplace service → Part C. In the event of a conflict between Part A and the relevant special part, the special part prevails. For institutional customers of the marketplace service, the data processing agreement (DPA) in accordance with the annex to Part C of the T&Cs also applies.

This privacy policy does not apply to the website www.fintogo.ai, unless it is used as an access point to one of the two products; the separate website privacy policy applies to this.

The app currently shows no advertising and uses no advertising, retargeting, analytics or crash-reporting system. We will inform you of future changes and any consents that may be required before they are introduced (see A.10).

A.3 Applicable legal bases

In accordance with Art. 13 GDPR, we inform you in Part B and Part C of the specific legal bases for our data processing. Unless stated otherwise there, the following generally applies: the legal basis for obtaining consent is Art. 6(1)(a) in conjunction with Art. 7 GDPR; the legal basis for processing to perform our services and carry out contractual measures and to respond to enquiries is Art. 6(1)(b) GDPR; the legal basis for compliance with legal obligations is Art. 6(1)(c) GDPR; the legal basis for safeguarding legitimate interests is Art. 6(1)(f) GDPR.

A.4 Cooperation with processors and third parties

Where, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them or otherwise grant them access, this only takes place on the basis of a statutory permission (e.g. performance of a contract under Art. 6(1)(b) GDPR), consent, a legal obligation or our legitimate interests. We conclude contracts with processors under Art. 28 GDPR where this is necessary given the nature of the processing. The specific categories of recipients used for each product are listed in Part B (B.4) and Part C (C.4).

A.5 Transfers to third countries

Where personal data is processed outside the EU or the EEA, this is done in compliance with Art. 44 et seq. GDPR. For this purpose we rely – depending on the respective recipient – in particular on an adequacy decision of the European Commission, including the EU-US Data Privacy Framework, or on EU standard contractual clauses under Art. 46 GDPR, supplemented where necessary by additional safeguards. Product-specific third-country transfers are described in Part B.4 and Part C.4.

A.6 Data security

In accordance with Art. 32 GDPR, and taking into account the state of the art, the costs of implementation and the nature, scope and risks of the processing, we take appropriate technical and organisational measures, in particular: encryption of data transmission (TLS/SSL); hashed storage of passwords; access and role concepts; regular backups; logging of security-relevant events; regular security updates. The protection of personal data is already taken into account when developing or selecting hardware, software and procedures (Art. 25 GDPR). Where necessary, contracts under Art. 28 GDPR are concluded with processors.

A.7 Retention period – general principles

Personal data is only stored for as long as is necessary to fulfil the respective purposes or statutory retention periods apply (in Austria in particular Section 132(1) BAO: generally 7 years for accounting records, vouchers and invoices; 22 years where real estate is concerned; 10 years for electronically supplied services under the Mini One Stop Shop/MOSS). After that, the data is deleted or anonymised. Anonymised or aggregated data without personal reference is not subject to storage limitation under Art. 5(1)(e) GDPR. Product-specific retention periods for personal data are listed in Part B (B.5) and Part C (C.6).

A.8 Data subject rights

Users of both products have the following rights under the GDPR:

Access to the data we hold about you (Art. 15 GDPR)

Rectification of inaccurate data (Art. 16 GDPR)

Erasure (Art. 17 GDPR)

Restriction of processing (Art. 18 GDPR)

Data portability (Art. 20 GDPR)

Objection to processing, in particular to processing based on legitimate interest (Art. 21 GDPR)

Withdrawal of any consent given, with effect for the future (Art. 7(3) GDPR)

Complaint to the competent supervisory authority (Art. 77 GDPR, see A.11)

To exercise these rights, an informal message to the contact details given in A.1 is sufficient. In the case of minors, data subject rights can also be exercised by their legal guardians where they are entitled to represent them; minors who have reached the age of discretion (mündige Minderjährige) can also exercise their rights themselves within the scope of their legal capacity. In the case of institutional use under Part C, data subject requests from students are primarily directed to the respective school/institution as the data controller; we support the institution in this in accordance with the DPA.

A.9 Cookies and tracking on the website/marketplace platform

On the website www.fintogo.ai and the web-based platform of the marketplace service (Part C), technically necessary cookies are used to ensure functionality. Cookies beyond this (e.g. for analytics or marketing purposes) are only used with prior consent (opt-in) under Art. 6(1)(a) GDPR in conjunction with the respectively applicable national provisions (in Austria Section 165(3) TKG) and can be withdrawn at any time via the browser or consent settings. For the native mobile app, the product-specific provision in B.7 applies.

A.10 Changes to this privacy policy

We reserve the right to amend this privacy policy, in particular in the event of changes in the law, new features or changed data processing – for example on the future introduction of advertising, analytics or additional third-party providers. A change to one special part (B or C) does not affect the other special part. In the event of material changes, we will inform you in a suitable form (e.g. in-app notice, platform notice or email) before they take effect. The current version is available in the app and on the platform respectively.

A.11 Right to lodge a complaint with the supervisory authority

Users have the right to lodge a complaint with a data protection supervisory authority, in particular in the state of their habitual residence, place of work or the place of the alleged infringement. In Austria this is:

Austrian Data Protection Authority (Österreichische Datenschutzbehörde)

Barichgasse 40–42
1030 Vienna

Telephone: +43 1 52 152-0
Email: dsb@dsb.gv.at
Web: www.dsb.gv.at

Users with habitual residence in Germany can additionally contact the competent state data protection authority; users with habitual residence in Switzerland can contact the Federal Data Protection and Information Commissioner (FDPIC), where its jurisdiction applies in the individual case.

Part B – Special provisions for the mobile app “fintogo”

Applies exclusively to the download and use of the app provided via the Apple App Store or – once available – Google Play by private individual users (B2C) in Austria, Germany and Switzerland. Supplements Part A; in the event of a conflict, Part B prevails.

B.1 Scope

Part B applies to all data processing in connection with use of the app under A.2 (registration/login, learning content, AI learning coach FINN, generation of your own study materials, AI podcasts, community features, moderation, Pro subscription, technical updates). It does not apply to the marketplace service (Part C applies to that). Version 1.0 of the app processes the same categories of data for the same purposes for all users regardless of age; processing that differs by age is not planned – apart from the age and consent check itself (B.6).

B.2 Data categories processed and purposes

B.2.1 Registration, login and user account

A user account is required to use the app. Registration or login can be done in one of three ways:

(a) Classic registration with an email address and a password of your choice (stored encrypted/hashed). In this case, users additionally choose a freely selectable display name/nickname for the community features (B.2.5); a legal name is not necessarily collected via this route.

(b) “Sign in with Apple”. Your identity is confirmed via Apple; depending on the user’s choice in the Apple dialogue, Apple may transmit your name and email address to us (possibly a private relay email address provided by Apple).

(c) Google Sign-In. Your identity is confirmed via Google; Google ID, name and email address are processed in the process.

For the community features (B.2.5), the following applies: when registering via Sign in with Apple/Google Sign-In, the name transmitted by Apple/Google is initially adopted into the account as the display name and is visible in this form in the community features (duels, leaderboard, shared study materials, ratings); users can replace this display name at any time afterwards in the account settings with a freely chosen display name. Until such a change, the adopted name remains visible to other users – an appropriate notice about this in the registration process is advisable and forms part of the general duty of transparency under Art. 13 GDPR.

In addition, we process: date of birth or age information – collected to check the minimum age of 14 (B.2.2 of the T&Cs) and to control age-dependent consent requirements, in particular for paid Pro subscriptions of minors and for the additional confirmation for 14- and 15-year-olds (see B.6); where applicable, information on the consent of legal guardians, if this is obtained in the registration or purchase process; an internal numerical user ID (users.id), which is used, among other things, for internal account management and for communication with the subscription management service provider (B.2.6a); Free/Pro status of the account.

Purpose: creating and managing the user account, confirming identity when logging in via third-party providers, providing the app functions according to the booked tier, age and consent check.

B.2.2 Use of the AI learning coach FINN and AI processing chain

When using FINN, we process questions and messages entered, the conversation context required for the respective answer, the answers generated and usage metadata for quota control.

When using FINN and other AI-supported functions, the content data required for the respective function is transmitted via our servers to OpenRouter as a technical intermediary platform and to Google AI models connected through it. In doing so, we generally do not transmit account data directly required for identification, such as name or email address, unless these are required for the respective function.

Processing takes place to provide the respective AI function on the basis of Art. 6(1)(b) GDPR. For transfers to the USA, the standard contractual clauses provided by OpenRouter under Art. 46 GDPR are used.

Users are advised not to enter any particularly sensitive data (e.g. health data, political opinions, religious beliefs) in the chat with FINN unless this is necessary for the learning purpose (corresponds to B.7.2 of the T&Cs).

B.2.3 Generating your own study materials (summaries, flashcards, quizzes)

When generating your own study materials, we process the source content entered or uploaded, the generated study materials themselves and usage metadata (number per month, scope per document for quota control).

Source content can in particular be entered text as well as uploaded PDF documents and images or photos. This content is transmitted as part of the AI processing described in B.2.2. In the case of uploads, the original file name may also be processed; users should therefore remove avoidable personal information from file names.

For uploaded third-party content protected by copyright, the person uploading it is responsible for compliance with rights; in terms of data protection, we process uploaded content only to provide the requested function.

The retention period of the uploaded original PDFs/images on the FTG backend is uniformly based on the account duration (see B.5); the legal basis and third-country transfer logic set out in B.2.2 for OpenRouter/Google apply accordingly to document/image content.

B.2.4 AI podcasts (FINN & FINNY) and your own audio recordings

When generating AI podcast episodes, uploaded files or selected learning content may be used to create a dialogue script as part of the processing described in B.2.2/B.2.3. Google Text-to-Speech is used for speech output; the generated dialogue text is processed. Your own audio recordings are not transmitted to the AI or speech output provider. We also process usage metadata for quota control.

For the third-country transfer to Google Text-to-Speech (USA), the same legal basis applies as set out in B.2.2 (Art. 6(1)(b) GDPR, standard contractual clauses as the transfer mechanism).

In addition to AI-generated podcast episodes, users can make their own audio recordings. According to the current state of play, these are processed exclusively locally on the device and can be deleted there.

B.2.5 Community features (duels, sharing/saving/rating study materials, leaderboard)

For duels we process the display name or the name stored in the account under B.2.1, current score and duel result vis-à-vis the respective opponent (including randomly assigned opponents). For shared study materials we process the shared content as well as the name/display name of the person sharing, visible to other users who view, save or rate the material. For ratings we process the rating given, possibly linked to the name/display name of the person rating. For the leaderboard we process name/display name and total score, visible to all users.

This data can be viewed by other users of the app within the respective function; it is not passed on outside the app. Version 1.0 of the app does not offer a direct messaging function between users; interaction is limited to the structured functions mentioned above.

The quantity limits for sharing and saving in the Free tier only affect the amount of use, not the scope of visible data – duels, ratings and the leaderboard are identical in Free and Pro in terms of data processing.

B.2.5a Automated content review, reports, blocks, sanctions

Community content is automatically checked for possible violations of the rules of use using a word list and with the help of the AI processing described in B.2.2. The check can take place when community content is released or reported.

Data processed for reports: reporting person, reported content or reported user profile, reason, optional free-text description (up to 500 characters), reported person, processing status, time. Reports remain stored even if the reported content is removed or hidden, in order to keep the process traceable. To protect against misuse of the reporting function, reports are limited to ten per account per day; repeated unfounded reports do not trigger any automatic action against the reported person.

Data processed for blocks: who blocked whom, time. A block works both ways and dissolves an existing friendship connection as well as ongoing duels between the accounts concerned.

Moderation log: Every automated or manual moderation decision is logged with time, occasion, reason and affected content (moderation_log). The number of confirmed violations and any restriction on the ability to share content (limited until a certain date or permanent) are also stored on the account.

Automated consequences (sanction ladder): If a violation is found, the content concerned is removed from the community; it is hidden, not deleted, and remains in the creator’s own library. In the event of repeated confirmed violations, only the ability to share content with the community is restricted automatically: first violation – warning; second violation – sharing blocked for seven days; third violation – permanent sharing block. The account, courses and own learning library remain unaffected and can still be used.

The automated removal of content and the restriction of the sharing function can take place without prior human review. Affected persons are informed of the measure and its reasons and can object using the contact address given in Part A.1. The objection is reviewed by a natural person.

If a user profile is reported, the name stored in the account (see B.2.1) may additionally be processed to support the preliminary review. The final decision on measures against a reported profile is made by the provider, not by the AI system alone.

B.2.6 Payment processing for Pro subscription (Apple/Google)

Pro subscriptions are concluded and billed exclusively through the in-app purchase systems of Apple or – once available – Google. Payment data (e.g. credit card or bank details) is processed exclusively by Apple or Google ; we do not receive it. Apple and Google act here as independent controllers, not as our processors; for refund/withdrawal requests relating to a specific purchase, the stores' own processes are primarily responsible (see B.4.5, B.6.3 of the T&Cs). For the technical management of subscription status, see B.2.6a.

B.2.6a Technical subscription management service provider (RevenueCat)

We use RevenueCat for the technical management of in-app subscriptions. In doing so, an internal user identifier, technical device information, country, purchase and transaction information and subscription status are processed. Name, email address and advertising ID are not actively transmitted to RevenueCat by FTG.

RevenueCat, Inc. (USA) processes this data as a processor under Art. 28 GDPR. The third-country transfer is based on the standard contractual clauses provided by RevenueCat.

B.2.7 Analytics, crash reporting and advertising tracking

The app currently uses no analytics, crash reporting, advertising or retargeting services. The advertising identifier is not used and there is no cross-product or cross-website advertising tracking. RevenueCat processes only purchase- and subscription-related data.

Should analytics, crash reporting, advertising or retargeting services be used in future, this privacy policy and any consents required will be updated before they are introduced.

B.3 Legal bases by processing purpose

Registration/login (incl. Only upon complete account deletion are personal data deleted or anonymised in accordance with the periods above, unless a statutory retention obligation prevents this. Account deletion is possible directly in the app and via the contact form on fintogo.ai or by email to office@fintogo.ai . Users are responsible for backing up their own data in good time before deletion.

B.6 Protection of minors

A significant part of the app’s target group consists of students at vocational secondary schools (including HAK/HAS) aged 14–19, a relevant proportion of whom are minors. The app is offered in Austria, Germany and Switzerland; the following rules apply uniformly in all three markets – apart from the country-specific particularities set out separately – without creating a different app experience depending on age.

Relationship to the store age rating: The Apple age rating (13+) is purely a content classification by the stores and not a minimum age under data protection or contract law; in particular, it does not not automatically lower the minimum age described below to 13 years. Only the minimum age of 14 years described below is decisive.

Minimum age: Registration and use – regardless of the login route chosen under B.2.1 (email, Sign in with Apple, Google Sign-In) – require a minimum age of 14 (B.2.2 of the T&Cs), uniformly in Austria, Germany and Switzerland. Independent registration under the age of 14 is not possible; a separate account managed by legal guardians for children under 14 is not offered in version 1.0.

14- and 15-year-olds (all three markets): When registering, these users additionally confirm that their legal guardians generally agree to the use (self-declaration, no separate verification). This additional confirmation is obtained uniformly regardless of the country of residence and the login route chosen.

From age 16: No additional confirmation required, regardless of country of residence.

Paid Pro subscription: For a Pro subscription, the minor additionally confirms that the costs are covered from their own funds or that their legal guardians have agreed; we recommend obtaining the guardians' consent before taking out a Pro subscription, as the store payment method often runs in their name. Where there are justified doubts, we may request proof and restrict use until the matter is clarified.

Particular care in AI interaction: The AI functions deliver automatically generated content that is not necessarily complete or error-free and does not constitute advice. Minors and legal guardians are advised not to enter any particularly sensitive data in the chat with FINN or in uploaded files (unless necessary for the learning purpose), to check AI outputs on their own responsibility, and that content shared as part of the community features and – depending on the login route – the stored name may be visible to other users (see B.2.1, B.2.5).

Consent under data protection law (Art. 8 GDPR) – significance in practice: Art. 8 GDPR is only relevant where processing is actually based on consent (not on performance of a contract). The core processing of this app (registration, FINN, study materials, podcasts, community features) is based on Art. 6(1)(b) GDPR (performance of a contract, see B.3), not on consent – Art. 8 GDPR is therefore not directly applicable to it. Art. 8 GDPR only becomes relevant once processing that is actually based on consent is introduced in future (e.g. future tracking, see B.2.7/A.10). In that case the following applies:

Austria: Consent threshold under Section 4(4) DSG at 14 years.

Germany: In the absence of a different national rule, the Art. 8 GDPR default threshold of 16 years applies; under 16, the consent of legal guardians would be required.

Switzerland: No direct GDPR equivalent; the decisive factor is the minor’s capacity of judgement in the individual case.

As no consent-based analytics or tracking processing is currently planned, this country differentiation currently has no practical effect. It will be taken into account when future consent-based functions are introduced.

No advertising, no profiling of minors: Since the app generally shows no advertising and uses no ad-tech/retargeting services (B.2.7, B.4), any advertising-related profiling is excluded for all users – regardless of age.

B.7 Cookies/tracking in the app

The mobile app does not use classic browser cookies. Technically necessary identifiers and the purchase- and subscription-related processing described in B.2.6a may be used. For tracking technologies requiring consent that may be added in future, a separate, revocable consent will be obtained before the first processing.

B.8 Technical updates and local device functions

To provide technical app updates, the app uses Expo Application Services. Information about the operating system and random technical identifiers may be processed in the process; there is no assignment to a fintogo user account. Further information on the provider and the third-country transfer can be found under B.4.

For audio recordings, the selection of photos or documents, opening external links and local caching, the app uses functions of the device. Unless described otherwise in the sections above, no additional data is transmitted to third parties as a result.

Part C – Special provisions for the marketplace service “fintogo – Rechnungswesen” (Accounting)

Applies exclusively to the service “fintogo – Rechnungswesen” obtained via the Marktplatz Lernapps (Marketplace for Learning Apps) (schools, educational institutions, authorities, teachers, individuals). Supplements Part A; in the event of a conflict, Part C prevails. Does not apply to the app (Part B). This part structurally continues the previous privacy policy that continues to apply separately to the marketplace service; its content remains unchanged in substance and is merely placed here in the common structure with Part A/B.

C.1 Scope and user groups

Part C applies to all use of the marketplace service, whether free of charge or paid. User groups: individual users (B2C: students aged 14 and over, university students, private individuals); institutions (B2B/B2G: schools, educational institutions, public bodies, commissioned teachers); partner companies (including CSR/sponsorship/education cooperations).

C.2 Data categories processed and purposes

C.2.1 Visiting the website/platform

When visiting, access data is logged automatically: IP address, date/time of access, browser type and version, operating system, referrer URL, access status. Purpose: functionality, system security, statistical evaluation. For security reasons, log file information is stored for a maximum of 7 days and then deleted, unless evidence purposes prevent this.

C.2.2 Registration and user account

A user account with complete, truthful information is required for use: name, email address, school/institution, date of birth where applicable. A subscription can be taken out by adults and by minors aged 14 and over; minors thereby affirm their minimum age and – where required – the consent of their legal guardians (C.3 of the T&Cs). Accounts for teachers, school administration or students can be commissioned by the school/authority under an institutional contract.

C.2.3 Use of the learning platform

On registration and use, the following are processed: learning progress, quiz results and interactions with the platform; usage behaviour for personalising learning content; inputs and answers of the AI-supported chat assistant for content support (processing by AI providers as sub-processors, see C.4). There is no automated decision-making within the meaning of Art. 22 GDPR with legal effect.

C.2.4 Institutional use by schools and teachers

Under the Basic subscription for educational institutions, teachers can manage class accounts, assign tasks and view learning progress, limited to data required for educational purposes (C.4 of the T&Cs). If a school, educational institution or authority orders licences for students, it is the controller under data protection law and the provider is the processor; the data processing agreement (DPA) in accordance with the annex to Part C of the T&Cs applies (see C.5).

C.2.5 Payment processing

For paid subscriptions (Pro subscription for private individuals, Basic subscription for individuals or educational institutions), we or the payment service providers used process payment and invoicing data for contract handling. For institutional customers, billing is generally based on an offer/framework agreement with the institution, not with individual students.

C.2.6 Contact form and email contact

When contacting us by email or contact form, the details (name, email, telephone where applicable, message) are processed to handle the enquiry and may be stored in a CRM system.
